These Terms and Conditions ("Terms") govern your use of the Rovy mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using Rovy, you confirm that you are at least 16 years old and agree to comply with these Terms and all applicable laws and regulations.

2. Description of Service

Rovy is a drive tracking application that allows users to:

• Record and monitor driving sessions including speed, distance, and route data.
• Track sprint performance (0-100 km/h times).
• View drive history and statistics in a personal logbook.
• Compete on leaderboards with other users.
• Connect an Apple Watch for heart rate monitoring during drives.
• Use CarPlay for in-car display.

3. Rovy Pro Subscription

Rovy offers a premium subscription ("Rovy Pro") that unlocks additional features. By subscribing:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID Account Settings.
• Any unused portion of a free trial period is forfeited when you purchase a subscription.

Prices are displayed in the App and may vary by region. Prices may change, but changes will not affect active subscription periods.

4. User Conduct

You agree to use Rovy responsibly. In particular:

• Safety First: Rovy is designed to be used as a passenger tool or reviewed after driving. Do not interact with the App while operating a vehicle. Always obey traffic laws and speed limits.
• Lawful Use: You must comply with all applicable traffic laws and regulations in your jurisdiction. Rovy does not encourage or endorse speeding, reckless driving, or any illegal activity.
• Accurate Information: You agree to provide accurate profile information and not impersonate others.
• Fair Play: You must not manipulate, falsify, or artificially inflate your drive data or leaderboard rankings.

5. Disclaimer of Liability

Rovy is not a precision instrument. Speed, distance, and other measurements are based on GPS data and device sensors, which may be inaccurate. Do not rely on Rovy for safety-critical measurements.

We are not liable for:

• Any traffic violations, accidents, injuries, or damages arising from your use of the App.
• Inaccurate speed, distance, or location readings.
• Any decisions you make based on data displayed in the App.
• Loss of data due to device failure, software bugs, or service interruptions.

6. Location Services

Rovy requires access to your device's location services to function. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You can revoke location access at any time through your device settings, but this will prevent the App from recording drives.

7. Leaderboard & Community Features

By participating in the leaderboard, you agree that your display name and drive statistics may be visible to other users. If you prefer not to share your data, you can enable Privacy Mode in the App's settings to hide your profile from the leaderboard.

We reserve the right to remove any user from the leaderboard who violates these Terms or engages in fraudulent activity.

8. Intellectual Property

All content, features, and functionality of Rovy, including but not limited to the design, graphics, text, and software, are owned by us and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

9. Termination

We reserve the right to suspend or terminate your access to Rovy at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Rovy and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Germany.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App or by updating the "Last updated" date above.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
